This Privacy Policy describes how SHSAT Buddy LLC ("we," "us," or "our") collects, uses, and discloses information when you (as a parent or legal guardian) register for a subscription and allow your child(ren) aged 12-17 to use the SHSAT Buddy mobile application (the "App"). We are committed to protecting the privacy of children and comply with applicable laws, including the Children's Online Privacy Protection Act (COPPA) in the United States. For users between the ages of 12 and 17, we will obtain verifiable parental consent before collecting and processing their personal information.

1. Information We Collect

  • Information Parents Provide: When you create an account, we collect personal information such as your name, phone number, email address, and payment information.

  • Child Profile Information: When you create a profile for your child who is between the ages of 12 and 17, we collect their name and date of birth. We will only collect this information with your explicit and verifiable consent.

  • Usage Data: We collect non-personally identifiable information about how your child uses the App, such as the quizzes they participate in, their scores, the time spent on quizzes, and general usage patterns. This data helps us understand the effectiveness of the educational content and improve the App. We use Mixpanel for this analytics purpose.

  • Device Information: We may collect certain information about the devices used to access the App, such as the device type, operating system, and device identifiers (e.g., device ID). We use this information for technical support and to ensure the App functions correctly across different devices. We may use anonymous or aggregated behavioral and location data to better understand user engagement and improve the App's performance. We do not use this data for advertising purposes or track users across unrelated apps or websites.

  • Push Notification Token: With your consent, we will collect a device-specific token to enable push notifications to remind your child to participate in daily quizzes.

2. How We Use Information

  • To Provide and Maintain the App: We use the information collected to operate the App, provide customer support, and personalize your child's learning experience by offering relevant quizzes.
  • Account Management: We use your parent account information to manage your subscription, process payments, and communicate with you about your account and updates to the App.
  • Improving the App: We analyze aggregated and anonymized usage data from Mixpanel to understand how the App is used and to identify areas for improvement and new educational content.
  • Safety and Security: We may use information to ensure the safety and security of the App and to prevent fraud and abuse.
  • Communication with Parents: With your consent, we may use your email address to send you important updates about the App, new features, and information about your child's progress (accessible through the parent web app).
  • Push Notifications: With your consent, we use push notification tokens to send reminders to your child to engage with the daily quizzes. You can manage these notifications through your device settings.
  • Leaderboards: Your child's initials and quiz results may be displayed on leaderboards. This feature is designed to encourage engagement and does not involve direct communication between users.

3. Collection of Children's Personal Information

We are committed to protecting children's privacy. We will only collect personal information from children through the App as described in this policy and with your prior, verifiable consent. We will not require a child to disclose more information than is reasonably necessary to participate in the App.

4. Disclosure of Information

We will not share your or your child's personal information with third parties except in the following limited circumstances:

  • With Your Consent: We may share information with third parties if we have your explicit consent to do so.
  • Service Providers: We use Mixpanel for analytics purposes to understand app usage. Mixpanel may collect certain information as described in their privacy policy. We ensure that our service providers are contractually obligated to protect the confidentiality and security of the information they process on our behalf. Mixpanel collects anonymized usage data only; it does not access personal identifiers such as your name, email, or payment details. We configure Mixpanel to avoid storing full IP addresses or persistent identifiers linked to individual children.
  • Legal Compliance: We may disclose information if required to do so by law, court order, or other legal process, or if we believe in good faith that such disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of others.
  • Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your and your child's personal information may be transferred as part of the transaction. We will notify you of any such change in ownership or control.

5. Data Security

We take reasonable measures to protect the personal information we collect from unauthorized access, use, or disclosure. These measures include TLS encryption, firewalls, secure cloud infrastructure, and regular access control audits. However, no method of transmission over the internet or method of electronic storage is completely secure, so we cannot guarantee absolute security.

6. Parental Rights and Controls

As a parent, you have certain rights regarding your child's personal information:

  • Review: You can review the personal information we have collected about your child by accessing their profile through your parent web app.
  • Deletion: You can request that we delete your child's personal information from our records by contacting us using the information below.
  • Consent Withdrawal: You can revoke your consent to our collection and use of your child's personal information at any time by contacting us. We will respond to such requests within 30 days. Deletion requests will result in removal of your child's personal information from our active databases, except as required by law. However, withdrawing consent may limit your child's ability to use certain features of the App.
  • Activity Monitoring: You can monitor your child's usage and quiz results through the separate parent web app.

7. Data Retention

We will retain your and your child's personal information for as long as necessary to provide the App and related services, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer need the personal information, we will securely delete or anonymize it.

If you are located outside of United States, please be aware that your personal information may be transferred to and processed in United States or other countries where our service providers (such as Mixpanel) are located. These countries may have data protection laws that are different from the laws of your country. By using the App, you consent to the transfer of your and your child's personal information to these countries. We will take steps to ensure that personal information is adequately protected in accordance with applicable data protection laws.

9. Third-Party Links and Services

The App does not contain links to third-party websites or services that are directed towards children.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated policy within the parent web app or on our website and, where appropriate, by sending you an email. We encourage you to review this Privacy Policy periodically for any changes. Your continued use of the App after the effective date of the revised Privacy Policy constitutes your acceptance of the changes.

11. U.S. State-Specific Privacy Rights

Depending on your state of residence (e.g., California, Connecticut, Virginia), you may have additional privacy rights under applicable laws such as the California Consumer Privacy Act (CCPA).
